Der BGH hat am 12. September 2013 I ZR 208\/12 ein wichtiges Urteil zur (Un-)Zul\u00e4ssigkeit von Empfehlungs-E-Mails verk\u00fcndet. Dem BGH lag folgender Sachverhalt vor: Der Kl\u00e4ger erhielt mehrmals ohne seine vorherige Einwilligung Produktempfehlungen der Beklagten, die auf ihrer Website eine Weiterempfehlungsfunktion eingerichtet hatte, wobei die Beklagte (auch) als Absender der Empfehlungs-EMail benannt war. Der Kl\u00e4ger hat daher einen Unterlassungsanspruch gegen\u00fcber der Beklagten geltend machen wollen. Die vorinstanzlichen Gerichte (AG und LG K\u00f6ln) hatten einen solchen mit der Begr\u00fcndung abgelehnt, dass der Beklagte f\u00fcr das missbr\u00e4uchliche Verhalten eines Dritten bez\u00fcglich der Weiterempfehlung nicht haften d\u00fcrfe.<\/p>\n
